Privacy Policy

Worx Plus Pty Ltd (WORX+) is committed to managing personal information in an open and transparent way in accordance with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth). This policy sets out the kinds of personal information we collect and hold; how we collect and hold it; the purposes for which we collect, hold, use and disclose it; how you may access and seek correction of your personal information; how you may complain about a breach of the APPs (and how we will deal with your complaint); and whether we are likely to disclose personal information to overseas recipients.

What is Personal Information and why do we collect it?

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. We collect personal information such as names, business and postal addresses, email addresses, telephone numbers, job titles, interaction history and device/usage data (including through cookies and analytics tools). We collect only what is reasonably necessary for our functions and activities, including: providing and supporting WORX+ products and services; account setup and billing; customer support; service notifications; maintaining and improving our offerings; security and fraud prevention; analytics and reporting; and compliance with legal obligations.

Anonymity and pseudonymity

Where lawful and practicable you may interact with us anonymously or under a pseudonym. However, identification may be required where we need personal information to provide our products or meet legal obligations.

Sensitive Information

Sensitive information includes information about racial or ethnic origin, political opinions, religious beliefs, trade union membership, criminal history and health information. We collect sensitive information only with your consent or where required or authorised by law. We will only use sensitive information for the primary purpose for which it was obtained, for a directly related secondary purpose that you would reasonably expect, with your consent, or as required or authorised by law.

Third Parties and Unsolicited Information

If we receive personal information we did not request, we will determine whether we could have collected it under APP 3. If not, and it is lawful and reasonable, we will destroy or de‑identify it as soon as practicable.

Notification at or before collection

At or before the time we collect personal information (or, if that is not practicable, as soon as practicable afterwards), we will take reasonable steps to notify you (or ensure you are aware of): our identity and contact details; the facts and circumstances of collection; whether collection is required or authorised by law; the purposes of collection; the consequences if personal information is not provided; the types of entities we usually disclose such information to; how to access and correct your information and our complaints process; and whether we are likely to disclose personal information to overseas recipients.

Use and Disclosure of Personal Information

We use and disclose personal information for the primary purposes described above. We may also use or disclose personal information for a secondary purpose where you would reasonably expect it and it is related to the primary purpose, where you have consented, or where required or authorised by law.

Direct Marketing

We may use your contact details to send you marketing about WORX+ products and services. Each marketing communication will include a simple means to opt out. Where we collected your details from a third party or you would not reasonably expect marketing, we will only market where permitted by law and will provide a prominent opt‑out. On request, we will tell you the source of your personal information unless impracticable or unreasonable. We only use sensitive information for direct marketing with your consent. We also comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).

Cookies, Website Usage and Analytics

We use cookies and similar technologies to operate and improve our websites and services (for example, to remember preferences, enhance security, measure performance and deliver relevant content). This may involve limited device and usage data being collected by us and by our analytics or advertising partners. You can manage cookies through your browser settings; however some features may not function properly if cookies are disabled. Where these technologies involve collection of personal information, we will provide appropriate notice at the time of collection. We don’t guarantee website links or policy of authorised third parties.

Overseas Disclosure and Cloud Hosting

Some of our service providers (including cloud hosting, support and analytics providers) are located outside Australia. Before disclosing personal information overseas, we take reasonable steps such as contractual privacy and security obligations, access controls and vendor due diligence to ensure recipients handle personal information in accordance with the APPs. Subject to statutory exceptions, WORX+ remains accountable under the Privacy Act for the handling of your personal information by overseas recipients.

Government Related Identifiers

We do not adopt, use or disclose government related identifiers (such as tax file numbers or Medicare numbers) as our own identifiers except where required or authorised by law.

Quality of personal information

We take reasonable steps to ensure that personal information we collect is accurate, up‑to‑date and complete, and that personal information we use or disclose is, having regard to the purpose, accurate, up‑to‑date, complete and relevant.

Security of Personal Information

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. When personal information is no longer needed for any purpose permitted by the APPs and we are not legally required to retain it, we will take reasonable steps to destroy or de‑identify it. Where specific retention periods apply (for example, under tax or corporate record‑keeping laws), we will retain information to satisfy those obligations.

Access to your Personal Information

You may request access to personal information we hold about you. We will respond within a reasonable period (aiming for 30 days) and provide access in the manner requested where reasonable and practicable. We do not charge a fee to make an access request, but we may charge reasonable costs to collate and provide copies. If we refuse access (in full or part), we will provide written reasons and information about how to complain.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

You may request that we correct personal information we hold about you. We will respond within a reasonable period and will not charge you to request or make a correction. If we refuse to correct, we will provide written reasons and information about complaint mechanisms and if you request associate a statement with the information. Where reasonable, we will notify third parties to whom we previously disclosed the information of any corrections.

Data Breach Notification

If a data breach is likely to result in serious harm to affected individuals, we will notify those individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable in accordance with the Notifiable Data Breaches scheme. Where we suspect an eligible breach has occurred, we will carry out a reasonable and expeditious assessment, generally within 30 days.
